Terms of Service

These Terms of Service ("Terms") govern your access to and use of bymark.ai and the Mark product (together, the "Service"), operated by the entity behind bymark.ai ("Company," "we"). Our formal legal entity name is in process and will be published here once finalized. By creating an account or using the Service, you agree to these Terms.
The Service
Mark is an AI content agent: it researches keywords against real data, writes articles in your brand voice, optimizes them for search engines (SEO) and generative engines (GEO), and publishes them to the CMS or channel you connect (currently WordPress, Webflow, HubSpot, Wix, or a Git repository as a pull request). You give it instructions over the web, WhatsApp, Slack, or Google Chat.
Accounts
You must provide accurate information to register and keep it up to date. You are responsible for activity under your account and for keeping your login credentials secure. Accounts are for use by one company or organization; the Agency plan additionally allows white-label use on behalf of that organization's own clients, as described on our pricing page.
Subscriptions and billing
Paid plans are billed monthly or annually in advance, in USD, through our payment processor, Stripe. Current plans, prices, and included article volumes are listed at bymark.ai/#pricing and may change with notice; changes do not apply retroactively to an already-paid billing period.
New subscriptions include a 14-day free trial; no card is required to start a trial. If you subscribe to an annual plan, you receive two months free compared to paying monthly.
Articles beyond your plan's monthly allowance are billed at the per-article overage rate shown on our pricing page for your plan. Unused articles do not roll over to the next month.
You can cancel or change your plan at any time from your account. Except where required by law, fees already paid are non-refundable.
Your content and your accounts
You retain all rights to the content Mark produces for you and to the site, brand, and integration accounts you connect. You are responsible for having the rights and permissions needed to let Mark research, write about, and publish to the sites and accounts you connect, and for reviewing published content for accuracy before relying on it.
You grant us a limited license to process your content and connected-account data solely to provide the Service to you, including sending it to the sub-processors described in our Privacy Policy.
Acceptable use
You agree not to use the Service to generate or publish content that is illegal, infringing, defamatory, or that violates the terms of service of a platform you connect (for example, a CMS's or search engine's own policies). We may suspend or terminate accounts that violate this section or attempt to abuse, reverse-engineer, or overload the Service.
No ranking guarantee
SEO and GEO outcomes — search rankings, AI-answer citations, and traffic — depend on factors outside our control, including search engine and AI platform algorithms, competition, and your own site. We do not guarantee specific rankings, traffic, or citation outcomes for any article.
Third-party services
The Service integrates with third-party platforms (CMSs, search-console, and chat providers) through Composio and each platform's own APIs. Your use of those platforms remains subject to their own terms, and we are not responsible for their availability, changes, or actions.
Intellectual property
The Service itself — its software, design, and the Mark name and marks — is owned by the Company. These Terms do not grant you any rights to our intellectual property beyond the right to use the Service as intended.
Disclaimer of warranties
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, to the maximum extent permitted by law.
Limitation of liability
To the maximum extent permitted by law, the Company will not be liable for indirect, incidental, or consequential damages, or for lost profits or lost data, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim arose.
Termination
You may stop using the Service and cancel your subscription at any time. We may suspend or terminate accounts that violate these Terms, with notice where reasonably possible.
Governing law
These Terms are governed by the laws of the jurisdiction in which the Company is registered, without regard to conflict-of-law principles. That jurisdiction is in process and will be published here once the Company's registration is finalized.
Changes to these Terms
We may update these Terms as the product changes. If we make material changes, we will update the date below and, where appropriate, notify you directly. Continued use of the Service after a change means you accept the updated Terms.
